No, that's not.
But downloading photos from a site that says......
The use of any photos or INDYCAR trademarks/logos obtained from this site is limited to valid news-reporting purposes only. Any other use, whether commercial or otherwise, requires the prior written consent of INDYCAR, LLC. Use of this site and any of its content, including without limitation photos, trademarks and logos, constitutes acceptance of these terms.
Is....correct????? Or am I off-base?
I don't know the original poster at all. Perhaps he or she are a member of the media who need the photos, if so, it would seem to be easy for him or her to sign up for the media sites, correct??

Your $100 bill analogy is also a poor one. the IMS media site has not been dropped & the owner gone from the scene. A photo server is indeed like an unlocked home... walking in is stealing. Yes the home owner should lock up his property, but blaming the victim doesn't make the crime go away. Also, not everyone goes with the finders keeps losers weepers concept. I've returned a pile of $20s that an old woman dropped... it was on the ground, no one saw it but me. However, the woman looked like that was her remaining cash... I picked it up & caught up to her in the parking lot to return her $$$.
Copyright laws & Internet Piracy are viewed as victimless crimes, but they cost people & companies a helluva lot of $$$. Ask the recording industry what they think about Napster... they proved their case in a court, but generations of people viewed "free music" as some kind of Constitutional right. Good bye local record stores/national chains... hello i-Tunes & cheap corporate music (well except for live concert prices...)

Why why why do so many posters here argue about "you said" "no, I said" "but here's your quote" "that's not what I mean" "you may think you know what you mean, but you don't really know, do you?"

Edit.
Thought better of it.
Now granted not everyone has the same view around copyright , SOPA etc , but id thought id bring up this case as it has a few parallels.
There was an interesting situation here in New Zealand a while ago. A right wing political blogger managed to gain access to a left wing party's restricted access website, where information such as membership details and donations were left. They had forgotten to change some of the website html or whatever restricting access to the database.
It was informally investigated by the Police and the Privacy commission, but he proved that he broke no law accessing the information as it was left open for the world to see. Essentially it was ruled that it if something is left open like that and no laws were broken in the process , it is fair game. He didnt release the information, which would have been illegal. Merely used to give people a fright.
So , with the Indycar media site, as it was accidentally open for all, it could be said it was fair game. Without knowing American law around the matter, i could hazard a guess that no law has be broken entering the website....
And as for the record industry ARROWZ46, their blind ignorance, head in the sand mentality has been their downfall more than anything. But lets not go there hahah!
nzirl: My same friend @LAT USA took a lot of heat for endorsing many aspects of those SOPA laws...
...he has just lost a helluva lot of $$$ from numerous sources over the years with folks that skirt copyright laws (some almost proudly...)
As for the recording industry... I agree my friend, its way too complicated to discuss @TF!!!![]()
Just to be clear doitagain, I am offended you yanked my posts!![]()
"Try some of these before or after your statements if you are not presenting them as facts. Things like - "In my opinion", or "I think that", JHMO, IMHO, IMO, JMO... Your opinions are not (necessarily) fact. That would clear things up some." - Seadog 03/25/2010 11:40am So the above is JMO.
The outcome of such a case here in the US would likely be the same... but your example doesn't apply in this case. The issue isn't that someone did an end run around a loosely secured web-site. The issue is the taking of copyrighted material that is expressly against the wishes of the owner while accessing the site.
In the US "facts" cannot be copyrighted. Lists of members or donors cannot be copyrighted. That notion was most recently put to the test here a number of years ago when phone companies tried to sue 3rd party telephone directory publishers by claiming that the names, addresses, and phone numbers contained in their "official" phone directories were copyrighted material. The case was tossed due to the fact that directories are just lists of "facts" and therefore cannot be copyrighted. ...photos are a different story.
While Jorgensen Eagle may have the bedside manner of a teamster, his/her opinions in this matter are dead-on.
