I hold out judgement on these issues now ever since experiencing an issue near my home town with an old acquaintance.
A friend of mine was actually charged with possessing child pornography about three years ago, and much like the normal situations I'm sure, no one ever suspected it. Our circle of friends was shocked by the situation, and it completely ruined his life. While under investigation, he was not allowed near children (obviously), so he had to give up his volunteer coaching, had to avoid shopping malls, lost his job, etc... However, he always maintained he was not guilty of the situation.
Well, about 8 months after originally being charged, the police showed up to his door step one morning, and he assumed he was being arrested and brought to jail. Well, much to his surprise, they said that all charges were being dropped. They had confused the IP addresses leading to this house (I'm not sure how IP addresses work, so if this sound technically wrong, I apologize). I guess they had gotten one of the numbers wrong in the IP address, and confused it with something pertaining to my friend. They apologized a bunch of time, and left.
After shattering his world and taking a great community member away from the community, all he was left with were apologies and was told to go back to living his life.
So, after that, I now reserve judgement until a court case is heard and a conviction is made. That does become hard to do sometimes with heinous crimes like these, but I do try my best.

Herb was a wealthy pay shoe who had no qualms about spending major clink to play in the IRL. He was a nice enough guy and I am shocked at this news in some sense but then, I have been told, the pedophile is the man or woman you least expect out of the crowd. Seems to hold true with many of the new stories we read. Let's see what the legal system has to say first. Innocent until proven guilty. But it doesn't look good.

I too prefer to hold judgement, but the evidence is pretty damning. Pictures and video, and he admitted it on the phone. Herb is a scumbag, and on his driving career, he was another unqualified loser with a big check in the old IRL that belonged in a bumper car not an Indy car.
One of the dreadful things about child abuse is often abuse begets abuse - many abusers were themselves abused as children...
The human mind is the strangest concept in the universe. Some people's brains get fried by what they suffered. If they are not in control of their own actions, they are not guilty.
Obviously that's a fairly big 'if'.
That Indy Pro race was phenomenal..ly bad. A wreck on the first lap, lengthy caution, wreck on the first green lap after caution, lengthy second caution, about 15 seconds of green in the first half hour. IIRC, they had to shorten a 100-mile race to 90 miles to avoid a conflict with TV for the IRL race.

John Herb's dad Marvin is extremely wealthy, owned Coca-Cola of Indy and Chicago, sold them to corporate for $1.4 billion in 2001. Presumably the family owned some piece of Dad's Root Beer.
In the NBC report above you can pause while they have the police report on screen and read what he is caught doing.
If the police report is correct, it's an easy conviction, and folks who do that to little girls get Dahmered in prison pretty quick.
I'd also say that you don't just decide to do stuff like that overnight, and folks around him probably suspected something was up with him.
